General sales terms
These general sales terms (“General Terms”) regulates the sales modalities and conditions of the products sold by ALLMYHOME (“Products”). All agreements for the Products sale by Arredamenti Camilletti Srl to third parties (“Customers”) are regulated by these General Terms, which are integral and essential part of every proposal, order and purchase order confirmation of the Products themselves. Sales terms which apply to product orders are those in force on the date of the order.
1. Products: prices and specifications
1.1 Unless otherwise stated, the prices of the Products shown on Arredamenti Camilletti Srl website are in Euro, including VAT but excluding delivery costs.
Deliveries outside the European Community (extra EU) do not include possible custom duties, which will be paid by the recipient and will be requested by the carrier at the time of delivery.
The price guaranteed to the buyer is stated on the website when placing the order. The price established during the purchase is fixed and final.
The prices of the Products published each time by Arredamenti Camilletti Srl on the website invalidate and replace the previous ones and are subject to the actual availability of Products.
The technical and functional specifications of the Products published by Arredamenti Camilletti Srl through information messages on the web pages where items are described, are communicated by their manufacturers. Arredamenti Camilletti Srl is not liable for the truthfulness and completeness of such information. Product pictures are for illustrative purpose only.
Free-trial products are not available. Despite ALLMYHOME operators can provide information on the Products specifications, Customers are responsible for the choice of the ordered Products and for the compliance and conformity of the specifications set out by each manufacturer to their own needs.
2. Orders – Invoicing
Each order sent to Arredamenti Camilletti Srl constitutes a Customer's contract proposal. The order processing by Arredamenti Camilletti Srl represents the order confirmation and acceptance.
Tax records related to the ordered Products will be issued by Arredamenti Camilletti Srl at the time of Products dispatch to the Customer.
Arredamenti Camilletti Srl will issue the invoice and the Customer shall indicate the necessary data for invoicing and invoice shipping address.
3. Order execution
The order will be executed according to the terms stated in the website.
In case of non-fulfilment of the order by Arredamenti Camilletti Srl (due to unavailability of the Products ordered by the Customer), Arredamenti Camilletti Srl will inform as soon as possible the Customer about the expected delivery times for the provision of the unavailable Product. If the Customer is not willing to wait such period of time, by the way not exceeding 30 working days, Arredamenti Camilletti Srl will refund the amount already paid for the unexecuted supply.
In case of Products’ breakage, unavailability or if they are out of stock, Arredamenti Camilletti Srl undertakes to inform the Customer as soon as possible, notifying the exact deadline for availability.
The Customer will confirm by e-mail his/her choice, meaning waiting for the product availability or asking for a refund.
4. Order acceptance
The conclusion of the agreement will take place only upon order confirmation by Arredamenti Camilletti Srl.
The Customer will receive by fax, mail or email a receipt notification stating the order confirmation with all the agreement elements (ordered products, prices, delivery date, shipping costs,...).
Arredamenti Camilletti Srl may not confirm an order for any reason due to problems of Products' provision or about the received order.
5. Delivery of the Products
The Products are delivered to the address indicated by the Customer.
Shipments will take place upon payment confirmation: if made by bank transfer, when the amount has been credited to our bank account, or by credit card when the transaction is confirmed by the system.
As for shipments, we rely on qualified express couriers specialised in the delivery of furniture in order to guarantee the quality of the service and the integrity of the Products.
Usually deliveries take place within 24/28 hours in Italy and 2/6 days for other destinations only for the products available in the warehouse. Delivery times are indicated in working days.
The delivery term of an order containing items with different delivery times is the longest of the items in the order. Possible delays in deliveries of less than 30 (thirty) days do not entitle the Customer to refuse the delivery of the Product or to ask for refund or compensation.
Arredamenti Camilletti Srl has the right to carry out, if deemed appropriate, the delivery of the Products (even if belonging to the same order) in more subsequently deliveries.
Delivery is considered accomplished when the Product is delivered to the Customer.
The delivery document issued by the carrier, dated and signed by the Customer upon delivery of the Product, proves the transportation and consignment of the goods.
Floor deliveries and Assembly
Goods are delivered at street level: carriers do not perform floor deliveries or collect second-hand items.
Arredamenti Camilletti Srl does not provide assembly services unless they have been previously arranged in writing. The majority of our products is pre-assembled: assembly is very often quite simple and usually consists in putting together already defined pieces.
It is important to know that:
At the time of delivery, the Customer will have to confirm the content, compliance and conditions of the Product/s. Therefore, upon delivery, Arredamenti Camilletti Srl recommends the Customer to verify the conditions of the delivered Products before signing the delivery notice, and in particular:
- that the number of delivered packages corresponds with that indicated in the attached shipping document;
- that the packaging is intact, not damaged, wet or modified, and check the integrity of the content.
If the Customer finds some anomalies, he/she shall refuse the delivery of the products or write the details of the possible damage. If the shipping document is signed without notifying any detail, the Customer will not be able to file any claim about the external characteristics of the delivered items. Any problem concerning the goods’ physical integrity, compliance or completeness shall be notified within 3 (three) days from the delivery.
Arredamenti Camilletti Srl has the right, at its discretion, to perform the delivery of the ordered Products with a courier of its choice.
Unless otherwise stated, all deliveries are performed at street level.
Special delivery conditions and terms shall be previously agreed between the Customer and Arredamenti Camilletti Srl and approved in writing by Arredamenti Camilletti Srl.
6. Products collection in case of customer absence
In case of absence of the recipient at the time of delivery, the carrier will leave a notice at the delivery address indicated by the Customer. The Products shall be collected at the address and according to the terms indicated by the carrier.
In case of failure to collect the goods within the term fixed by the carrier, the Products will be returned to Arredamenti Camilletti Srl, which reserves the right to refund the price of the Products, with delivery costs at the expense of the Customer.
If there is a mistake regarding the Product, the Customer is committed to return such Product or Products to Arredamenti Camilletti Srl within 7 (seven) days from the receipt, provided that goods are returned in a closed package, in their original conditions and packaging, together with their delivery documents.
Once the Product has been received as above, Arredamenti Camilletti Srl will send back, at its own expenses, the Product that was initially ordered.
7. Acts of god/nature
Acts of god/nature, in addition to those normally considered by the law, also include the following cases:
- Total or partial strikes, internal or external to the company, block of means of transport or supply for any reasons, legal or governmental restrictions, malfunction of information technology and telecommunications, including networks and Internet.
In such case the execution of the order will be suspended.
If after 3 (three) months the parties verify the persistence of such act of god/nature, the order will be automatically cancelled, unless otherwise agreed by the parties.
8. Products guarantee – Technical support
Arredamenti Camilletti Srl only guarantees the material integrity of the Products at the time of delivery (hereinafter, “Arredamenti Camilletti Srl Guarantee”).
8.1 Possible flaws covered by Arredamenti Camilletti Srl Guarantee shall be notified by the Customer, under penalty of forfeiture, within 10 (ten) days from the delivery date. In case Arredamenti Camilletti Srl Guarantee is applicable, the Customer shall have the right to the replacement of the damaged Products only after returning them, being excluded the Customer’s right to the reimbursement of any damage. The shipping costs for the replacement of the Products shall be borne by Arredamenti Camilletti Srl.
8.2 Notwithstanding the provisions of art. 8.1, Arredamenti Camilletti Srl does not provide any additional guarantee on the Products besides the one provided by the individual Producers.
Technical support and interventions on the Products under guarantee are performed, if applicable, by the individual Producers, in accordance with the terms and conditions stated in the documents attached to the Products.
In particular, Arredamenti Camilletti Srl does not provide any kind of guarantee on the compatibility of the Products with other items or equipment used by the Customer. Moreover, it does not provide any kind of guarantee on the suitability of the Products for the specific use expected by the Customer.
8.3 Except in case of wilful misconduct or gross negligence by Arredamenti Camilletti Srl, it is agreed that, if the liability of Arredamenti Camilletti Srl against the Customer is ascertained due to any reason - including total or partial non-fulfilment to the obligations undertaken by ALLMYHOME towards the Customer as a result of an order execution - the liability of Arredamenti Camilletti Srl cannot exceed the price of the Products bought by the Customer and for which the dispute has arisen.
9. Right of withdrawal
9.1 Pursuant to art. 5 of Leg. Decree dated 22nd May 1999 n. 185, the Customer (if considered as "consumer" under art. 1 lett b) of Leg. Decree dated 22nd May 1999 n. 185) has the right to withdraw from the agreement and return the ordered Products, without any kind of penalty and without specifying the reason, within 14 (fourteen) days from the delivery of the Products.
9.2 The right of withdrawal, according to the previous art. 9.1, can be exercised by the Customer within 14 days from the physical receipt of the goods.
To exercise the right of withdrawal the customer shall send a declaration of withdrawal by filling in the attached form. The declaration shall be sent to Arredamenti Camilletti Srl following one of these modalities:

by fax to the number +39 0732 970399;
by email to email@example.com;
In order to comply with the withdrawal period just send the notice concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.
In case of withdrawal from the contract any payment made to us will be refunded, including delivery costs (except for the additional costs arising from the possible choice of a type of delivery other than the less expensive standard one offered by us), without undue delay and in any event not later than 14 days from when you notified us your decision to terminate this agreement.
Such refunds will be made by using the same payment method used for the initial transaction, at no additional cost.
Reimbursement may be suspended until receipt of the goods, or until demonstration by the consumer to have returned the goods.
9.3 Withdrawal effects: In case of withdrawal from the contract any payment made to us will be refunded, including delivery costs (except for the additional costs arising from the possible choice of a type of delivery other than the less expensive standard one offered by us), without undue delay and in any event not later than 14 days from when you notified us your decision to terminate this agreement.
Such refunds will be made by using the same payment method used for the initial transaction, at no additional cost.
Reimbursement may be suspended until receipt of the goods, or until demonstration by the consumer to have returned the goods.
9.4 Goods must be sent back or returned to the following address:
Arredamenti Camilletti, via Crocifisso 41/A, 60041 Sassoferrato (AN), without undue delay and in any event within 14 days of notification of withdrawal from the contract. The term is fulfilled if the goods are returned before expiry of the period of 14 days.
9.5 The direct costs of goods returning will be borne by the customer.
The customer is responsible only for the diminished value of the goods resulting from an alteration other than the necessary one to establish the nature, characteristics and functioning of the goods.
The returned goods must be in the conditions to be sold again.
Custom-packaged or easily perishable goods are excluded from the right of withdrawal.
9.6 The right of withdrawal referred to in article 9.1 cannot be exercised by the Customer if the purchased products have been manufactured according to the customer's requests, or they are customised, or may deteriorate or expire rapidly.
9.7 Arredamenti Camilletti Srl recommends the Customer to check the conditions of the products delivered before signing the receipt notice, and in particular that the number of delivered packages corresponds to that indicated in the transport document attached to the shipping and that the packaging is not damaged, or wet or anyhow altered, and to check the integrity of the content.
If discrepancies are found, the Customer may refuse to accept the package, signing the refusal.
Order payment is due from the time of the order.
The Customer undertakes to pay the agreed price for the Product ordered from the website (product and shipping price) and also to pay, if necessary, directly to the carrier, the VAT or other taxes concerning the import of Products in the countries where delivery will take place.
The Customer settles the order according to one of these modalities:
- by credit card as proposed on the website: the Customer grants Arredamenti Camilletti Srl to have the necessary permission to use this payment method;
- bank transfer to Arredamenti Camilletti Srl: in case of non-receipt by Arredamenti Camilletti Srl in the next 14 days after order confirmation, Arredamenti Camilletti Srl reserves the right to cancel the order. Bank details are provided at the time of the order;
- or by Paypal: the Customer grants Arredamenti Camilletti Srl to have the necessary permission to use this payment method.
11. Non-payment - Retention of title
The ordered products remain of property of Arredamenti Camilletti Srl until final payment of the full price (under art. 1523 et seq. CC.) Arredamenti Camilletti Srl reserves the right to claim the ordered Products in the event of non-payment.
In this case, and at the request of Arredamenti Camilletti Srl, the Customer undertakes to return any unpaid product with costs at his/her own expenses.
Claims for non-compliance of the delivered Products with the order shall be submitted in writing directly to Arredamenti Camilletti Srl, immediately upon receipt of the goods. We recommend the Customer to keep the original packaging and the delivery document.
13. Personal information
Computerized processing of information, including the management of e-mail addresses of the website users, is carried out in accordance with the provisions of law.
Personal information required to the Customer is necessary for processing and forwarding orders, invoicing and possible guarantee contracts, if any.
For this purpose, this information may be communicated to the contractual partners of Arredamenti Camilletti Srl.
The Customer may object to such a disclosure and under the law he/she has the right to access, modify, rectify and delete data concerning him/her by contacting Arredamenti Camilletti, via Crocifisso 41/A, 60041 Sassoferrato (AN).
To prevent any fraud attempt, Arredamenti Camilletti Srl may ask a proof of your identity or your address.
14. Electronic signature
The "click of validation" constitutes an electronic signature. This electronic signature has the same value as a handwritten signature between the parties.
15. Waiver failure
For Arredamenti Camilletti Srl the fact of disregarding a Customer's fault with respect to any of his/her obligations shall not be interpreted as a waiver of the obligation in question and the possibility to enforce this fault later on.
16. Entirety of the contract
The present general conditions of sale constitute the entirety of the obligations of the parties.
No other general or specific condition communicated by the Customer may be included or excluded from these general conditions.
17. Intellectual property
Arredamenti Camilletti Srl is holder of intellectual property rights of the website and of the disclosure right of the elements contained in the catalogue of the online shop. Therefore, the partial or total reproduction, on any type of media, of the elements of the website and catalogue, their use and transfer to third parties are formally prohibited.
18. Void contract
If one or more provisions of these general terms and conditions are considered or declared void pursuant to a law, regulation, or following a final decision taken by a competent jurisdiction, the other provisions will keep all their force and validity.
In the event of litigation and in the absence of an amicable agreement between the parties, subject to any applicable mandatory law provisions protecting consumers (as defined pursuant to art. 1 lett. b) of Legislative Decree dated 22nd May 1999 n. 185), whichever controversy related to the present General Conditions, will be subject to the exclusive jurisdiction of the Court of Pesaro.
Pursuant to and for the purposes of articles 1341 and 1342 of the Italian civil code, the Customer declares to have carefully read and understood and accepts the following clauses of the General Conditions of sale by Arredamenti Camilletti Srl
Pursuant to and for the purposes of article 13 of Legislative Decree dated 30th June 2003, n. 196, containing provisions for the protection of personal data, Nomination Srl, via F.lli Bandiera 22, 50019 Sesto Fiorentino, VAT n. 05018590488, acting as data controller, informs you that your personal data, collected through www.allmyhome.test website (the "Website"), will be processed for the following purposes:
to allow managing the relationship between the Visitor/Customer and our Company;
for administrative purposes related to the Visitor/Customer requests, or for the fulfilment of legal obligations;
to allow, subject to your consent, the registration to the newsletter;
to allow the proper execution of purchases through the "Website";
to allow, subject to your consent, marketing activities such as: sending of advertising, promotional and informative material, as well as for market research;

The provision of data in relation to the purposes referred to in points c), f), g) is optional and their use is subject to the issue of consent. The refusal will make it impossible to proceed with the subscription to the newsletter, to send you information and advertising material, brochures and communications about products, promotions and services offered by our Company.
As for the sending of advertising, promotional, informative material and/or brochures we report that the consent to the processing of personal data may be revoked at any time by selecting the check box "delete", which can be accessed through a link contained in the communications sent.
2. The processing of personal data will be carried out primarily by means of computer, ITC or automated tools to ensure data security and confidentiality, in accordance with the requirements of the Privacy Code.
We also inform you that our Company uses visitors' IP addresses, in a totally anonymous way, to monitor traffic on the Website.
3. The personal data provided will be processed by the staff and employees of our Company in charge of data processing. Personal data may also be transferred abroad to companies which collaborate and/or are part of Arredamenti Camilletti Srl.
The data provided, if needed, may be communicated to the following subjects:
Subsidiaries and/or associated companies of Arredamenti Camilletti Srl;
Post Offices, or other mail delivery companies, couriers, etc;
Banks and credit institutions, management systems of credit card payments;
Individuals, companies, associations and/or professional firms that provide assistance and consultancy to our company, including those in charge of the management, maintenance and upgrading of hardware and software systems;
Firms and insurance companies;
Public authorities, judicial offices, chambers of Commerce for fulfilment of obligations arising from law;

5. The personal data provided will be kept for the time necessary to ensure the proper execution of the services offered, save the need to keep them for a longer period in compliance with the regulations in force.
After this period, your personal data will be processed anonymously.
The consent to the use of personal data for marketing purposes may be revoked at any time with a simple request to be forwarded to the email address: firstname.lastname@example.org.
6. In accordance with art. 7 of the Privacy Code (Legislative Decree No. 196/2003), in addition to the information provided in this policy, the party concerned is entitled to obtain, at any time, confirmation of the existence of data concerning him/her at our Company, even if not yet recorded, and their communication in an intelligible form;
The person concerned also has the right to obtain confirmation:
a) of the origin of personal data;
b) of the purposes and methods of processing;
c) of the logic applied in case of processing carried out with the aid of electronic instruments;
d) of the identity of the data controller, data processors and the appointed representative;
e) of the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them acting as appointed representative in the State territory, of managers or entrusted persons.

Security and guarantee
All the items of our e-shop are covered by 24-month guarantee for conformity defects.
In case the acquired product turns out to be damaged because of the transport or has production defects, ALLMYHOME is engaged to replace the product in guarantee and send it without extra charges to the address indicated in invoice in the shortest time possible.
In order to take advantage of this right please send a written notice within 5 days from the date of goods receipt to Arredamenti Camilletti Srl or via fax to the number +39 0732 959436 or via email firstname.lastname@example.org.
In the request please state the reference details of the order, the product damaged or the details of the defect. Our Customer Service will contact the customer in order to agree the replacement. The product to replace must be sent with original and accurately sealed packaging.
Arredamenti Camilletti Srl, with registered office in via Mura Malatestiane 41/A, 61032 Fano (PU), creator and manager of the e-commerce website allmyhome.co, reserves the right to use the personal data, supplied voluntarily by the Customers, in compliance with the law in force (art 13 and following Leg. Decree 196/2003).
